Greenhouse Connect Community Terms of Use

These Community Terms of Use ("Terms") govern your access to and participation in the Greenhouse Connect community ("Community"), operated by Greenhouse Software, Inc. ("Greenhouse," "we," or "us"). The Community is hosted on a third-party platform provided by Gainsight, Inc. ("Platform Provider"). By accessing or using the Community, you agree to be bound by these Terms. If you do not agree, do not access or use the Community.

These Terms supplement and are in addition to the terms of Greenhouse’s Master Subscription Agreement ("MSA"), which are incorporated herein by reference. In the event of a conflict between these Terms and the MSA, these Terms will control with respect to your use of the Community.

  1. Eligibility and Access

    Access to the Community is available to authorized users of Greenhouse products and services. Greenhouse may, in its sole discretion, grant or revoke access to the Community at any time and for any reason. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may maintain only one account. If multiple accounts are detected, Greenhouse reserves the right to suspend or remove any secondary accounts.

  2. Acceptable Use

    You agree to use the Community solely for its intended purpose: to collaborate with peers, share knowledge, and engage in discussions related to talent acquisition and use of Greenhouse products. You agree not to:

    1. Post, upload, or transmit any content that is unlawful, defamatory, harassing, threatening, obscene, or otherwise objectionable;

    2. Share personal data of any individual, including candidates, employees, or other third parties, or any confidential or proprietary information belonging to your employer or any third party;

    3. Use the Community to solicit business, advertise products or services, recruit members, or engage in any commercial activity not expressly authorized by Greenhouse;

    4. Collect, scrape, harvest, or otherwise gather information about other members, including for competitive intelligence purposes;

    5. Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

    6. Introduce any virus, malware, or other harmful code, or attempt to gain unauthorized access to the Community or its systems;

    7. Interfere with or disrupt the Community, its servers, or networks connected to the Community;

    8. Derail or "hijack" discussion threads by posting content unrelated to the original topic; or

    9. Violate any applicable law, regulation, or third-party right.

  3. User-Generated Content

    3.1 Ownership. You retain ownership of any content you post, upload, or otherwise submit to the Community ("User Content"). You are solely responsible for your User Content and represent that you have all rights necessary to post it.

    3.2 License Grant. By posting User Content, you grant Greenhouse a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, display, distribute, and create derivative works from your User Content in connection with operating, promoting, and improving the Community and Greenhouse's products and services.

    3.3 No Endorsement. Greenhouse does not endorse, verify, or guarantee the accuracy, completeness, or reliability of any User Content. All User Content reflects the views of the individual member who posted it, not Greenhouse.

  4. Moderation and Enforcement

    Greenhouse reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content at its sole discretion and for any reason, with or without notice. If you violate these Terms or the Community Guidelines, Greenhouse may, at its discretion:

    1. Issue a warning;

    2. Temporarily or permanently suspend your Community access;

    3. Remove your User Content; or

    4. Take any other action Greenhouse deems appropriate.

    Moderation decisions are final. If you wish to discuss a moderation action, contact the Community team via private message or at connect@greenhouse.io. Public discussion of moderation actions within the Community is not permitted.

    To report a violation, contact connect@greenhouse.io or use the in-community reporting feature.

  5. Privacy, Data Collection, and Cookies

    5.1 Privacy Policy. Your use of the Community is subject to the Greenhouse Privacy Policy. By participating in the Community, you acknowledge that your profile information, posts, and other activity within the Community will be visible to other members and Greenhouse staff. Do not post any information you wish to keep private.

    5.2 Third-Party Platform. The Community is hosted on a platform provided by the Platform Provider. Your use of the Community is also subject to the Platform Provider's privacy policy, available at https://www.gainsight.com/policy/privacy/. Greenhouse is the controller of personal data collected through the Community. The Platform Provider processes such data on Greenhouse's behalf in accordance with its agreement with Greenhouse.

    5.3 Cookies. The Platform Provider uses cookies (small files stored on your device) to operate the Community, recognize your device on subsequent visits, and analyze Community usage. Cookies used by the Community do not store personal information. You may adjust your cookie preferences at any time by clicking "Cookie settings" in the Community footer. Three settings are available:

    1. Basic: Functional cookies only

    2. Normal: Functional and analytics cookies

    3. Complete: Functional, analytics, social media, and embedded video cookies

    You may also disable cookies through your browser settings; however, doing so may affect the functionality or display of certain Community features. For full details on the types of cookies used and how cookie data is processed, refer to the Platform Provider's privacy policy https://www.gainsight.com/policy/privacy/.

    5.4 Analytics. The Platform Provider collects browsing data from Community users on Greenhouse's behalf to support Community operations and improve the user experience. Greenhouse will not use this data to send you unsolicited communications or sell it to third parties. The Platform Provider may use aggregated, de-identified data derived from Community usage for its own purposes, including platform performance analysis and product improvement. Such aggregated data will not identify you or your organization.   6. Intellectual Property

    All content, features, and functionality of the Community (excluding User Content), including text, graphics, logos, icons, and software, are the property of Greenhouse or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Greenhouse's trademarks, trade names, or logos without prior written consent.

  7. Third-Party Links and Resources

    The Community may contain links to third-party websites or resources. Greenhouse provides these links for convenience only and is not responsible for the content, products, or services available through third-party sites. Your use of third-party resources is at your own risk.

  8. Disclaimer of Warranties

    THE COMMUNITY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GREENHOUSE DOES NOT WARRANT THAT THE COMMUNITY WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY USER CONTENT IS ACCURATE OR RELIABLE. ANY RELIANCE ON USER CONTENT OR OTHER INFORMATION OBTAINED THROUGH THE COMMUNITY IS AT YOUR OWN RISK.

  9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GREENHOUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE COMMUNITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF GREENHOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GREENHOUSE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE COMMUNITY WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

  10. Indemnification

    You agree to indemnify, defend, and hold harmless Greenhouse and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Community; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

  11. Changes to These Terms

    Greenhouse may update these Terms at any time by posting the revised version to the Community. The "Last Updated" date at the top will indicate when changes were made. Your continued use of the Community following any changes constitutes your acceptance of the revised Terms. Greenhouse will make reasonable efforts to notify members of material changes.

  12. Termination

    Greenhouse may terminate or suspend your access to the Community at any time, with or without cause and with or without notice. Sections 3.2, 5, 8, 9, 10, and 12 will survive any termination of these Terms.

  13. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of those courts.

  14. General Provisions

    1. Entire Agreement. These Terms, together with any documents incorporated by reference, constitute the entire agreement between you and Greenhouse with respect to the Community.

    2. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

    3. Waiver. Greenhouse's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

    4. Assignment. You may not assign or transfer these Terms without Greenhouse's prior written consent. Greenhouse may assign these Terms without restriction.
